Sandusky attorney: problems in McQueary timeline

Tuesday’s hearing for Jerry Sandusky should reveal some of the actual evidence involved in the criminal case. Sandusky’s attorney, Joe Amendola is going over what some have called his non-traditional defense approach in the final hours before his client appears before a judge.

One key argument Amendola says he’s sure to raise involves Penn State football assistant coach Mike McQueary and what he saw that day he says he witnessed Sandusky raping a child in the Lasch football building.

 Sandusky is facing more than 50 criminal charges.  In recent days, various stories have emerged about the alleged victims.  Amendola says there may be problems in the prosecution’s timeline-surrounding a key piece of evidence.

Simply known as victim 2 in the grand jury report; it’s the story that led to the ousters of both former coach Joe Paterno and former university president Graham Spanier, along with charges filed against university administrators Tim Curley and Gary Schultz.

According to the grand jury presentment, assistant football coach Mike McQueary testified he saw Sandusky raping a boy, victim 2, in a shower at the university football headquarters. Prosecutors say it happened in 2002. But Sandusky, who denies having sex with any of the victims, says he and victim two were horsing around in a shower, and that happened a year earlier in 2001.

“We have problems with the prosecution’s timeline.  We hope to get it straightened out at the preliminary hearing,” Amendola says. 

Sandusky says he remembers he had just returned from applying for a job at the University of Virginia in 2001.

Various Penn State sources tell 6 News they also remember the incident happening in 2001and not 2002.
