Former Penn State vice president Gary Schultz filed a motion in Dauphin County Court Monday to separate his case from that of former Penn State athletic director Tim Curley.
According to court documents, Schultz also wants to separate his charge of felony perjury from his summary charge of failure to report, of which he has previously pursued dismissal.
A spokeswoman for the court, located in Harrisburg, said in an email that a similar motion is being filed by Curley, though the court has yet to receive it.
Curley and Schultz were charged with felony perjury for having allegedly lying to a grand jury and a summary charge of failure to report for not reporting former Penn State assistant football coach Jerry Sandusky’s suspected child abuse in Feb. 2001.
The incident was originally thought to have occurred in March 2002, which allowed the Commonwealth to charge the men because they were still within the statue of limitations.
Trial has been scheduled for Jan. 7, though Schultz’s attorney asked for a change of date in the trial should the cases be separated.
Curley and Schultz have both maintained their innocence through their attorneys.
