A hearing scheduled for this week on the NCAA’s request to throw out Gov. Tom Corbett’s antitrust lawsuit has been postponed, according to court documents filed yesterday.
Judge Yvette Kane delayed the oral argument because she plans to attend the funeral of the late Chief U.S. District Judge Gary Lancaster, who passed away last week.
The hearing has been rescheduled for May 20 at 2 p.m. in Courtroom 1 of the federal courthouse in Harrisburg.
Corbett announced his lawsuit against in the NCAA in January, which aims to reverse the NCAA’s sanctions against Penn State. He claims the sanctions violate antitrust laws. The NCAA argues that Cobett and Pennsylvania have no standing in the case because Penn State entered into a private agreement with the NCAA.
Corbett said at the time that the NCAA sanctions “threaten to have a devastating and irreparable effect on the commonwealth, its citizens and its economy.”
